When Injured on Someone Else’s Property, Who is to Blame?

by

Property owners have a duty to provide a reasonably safe environment for other who may enter their establishment. In the legal world, we call this premises liability.

When someone is injured on another person’s property and sues, courts first seek to determine whether the injured was allowed on the premises. If the owner consents to a person’s entry on the property, the person is deemed an invitee or licensee. When consent is not given, the person is considered a trespasser.

A property owner may be liable for injuries of an invitee or licensee if:

  • Accidents are due to maintenance or negligence.
  • Inappropriate hiring or retention of employees with criminal backgrounds causes injury.
  • Broken stairs, wet floors, dangerous sidewalks, or other hazardous conditions cause a slip-and-fall accident.

Property owners may also be held responsible for damages caused by negligent security. When an owner is aware of criminal activity in the area, it is his or her duty to provide special care to ensure safety for the guests, even in the parking lot or parking garage.

McAleer Law has helped numerous clients recover damages in negligent security cases, most recently involving a restaurant owner who failed to protect his patrons in a location where high amounts of criminal activity were reported. When a armed robbery took place at the restaurant, the injured guest successfully sued the company for negligent security.

So, how do we help you win a premises liability case?

We represent clients on a contingency basis, which means we only charge an attorney fee when we win on your behalf. The success of your premises liability case is contingent on our ability to listen carefully, understand the injury’s impact on your life, and establish the property owner’s breach of duty.

We always put in the hard work, time, and effort to take care of our clients in situations where a property owner did not.
